Absolute Trademark & Affiliation Disclaimer (Safe Harbor)

• No Official Affiliation: Elixir Cipher Perfumes is a wholly independent reseller and decanter of luxury and designer fragrances. We are not affiliated, associated, authorized, endorsed by, or in any way officially connected with any original brand manufacturers, designers, or distributors (e.g., Rasasi, Armaf, Afnan, Chanel, Dior, Tom Ford, etc.) whose products we stock.
• Intellectual Property Rights: All product names, trademarks, logos, and brand imagery displayed on our platform belong strictly to their respective trademark holders. Our utilization of these names is purely descriptive, designated to identify the original liquid scent profile being purchased.
• Nature of Decants: Our decants are not factory-sealed products. They are authentic liquids hand-poured, extracted, and transferred by Elixir Cipher Perfumes from the genuine bulk bottles into our independent, sterile vials. The final retail product delivered to you is processed exclusively by us.

Sourcing, Authenticity, & Batch Variations

• 100% Authenticity Guarantee: We explicitly guarantee that all fragrances used in our decanting process are 100% genuine, procured legitimately from authorized distributors, retail channels, or verified parallel imports.
• Manufacturer Reformulations: We carry no liability for variations in scent longevity, performance, projection, or color caused by manufacturer reformulations or distinct manufacturing batch codes.
• Packaging Aesthetics: The atomisers, visual shapes, and design aesthetics of the decant vials sent to you depend entirely on current stock availability and will not match the original brand's retail packaging.

Health, Cosmetics Safety, & Medical Indemnity

• Allergy Awareness: Fragrances contain synthetic compounds, alcohol, and natural essential oils that can induce skin irritation, contact dermatitis, or respiratory reactions in sensitive individuals.
• Mandatory Patch Test: The buyer assumes all health risks. We strictly mandate that you perform a localized patch test on a small skin area before applying any fragrance fully.
• Liability Waiver: Elixir Cipher Perfumes, its owners, and staff are completely exempt from liability for any adverse dermatological, medical, or physiological reactions, including but not limited to skin rashes, respiratory discomfort, chemical burns, or staining of personal property/clothing resulting from the application of our products.

Cash on Delivery (COD) & Payment Framework

• Standard Prepaid Orders: We accept 100% secure online payments via UPI, Credit/Debit cards, and Net Banking for all order values across India.
• Partial COD Threshold: Cash on Delivery (COD) is strictly unavailable for orders below ₹2,000. For orders exceeding ₹2,000, we offer a Partial COD facility to mitigate transit defaults.
• Non-Refundable Advance: To activate Partial COD, you must pay a mandatory 25% advance online payment at the time of placing the order. The remaining 75% balance must be paid in cash/digital modes to the delivery agent upon physical receipt of the package.
• Forfeiture on Rejection: If a Partial COD order is rejected at the doorstep, delivery is refused, or the customer is unreachable after three delivery attempts, the 25% advance payment will be strictly forfeited by Elixir Cipher Perfumes to cover forward and reverse logistics costs.

PAN India Shipping, Transit Risk, & Leakage Policy

• Shipping Contract: All orders placed for PAN India delivery are fulfilled via third-party courier services (e.g., Blue Dart, Delhivery, DTDC). Risk of loss, damage, and title for the goods pass to you the moment the package is handed over to our shipping partner.
• Micro-Leakage & Evaporation: Due to pressure alterations during domestic air or surface transit within India, microscopic seepage or minimal evaporation may occasionally occur despite our industrial-grade sealing (Teflon wrapping). Minor leakage that does not significantly deplete the volume of the decant does not warrant a replacement or refund.

Mandatory Unboxing Video Policy (Transit Claims Protection)

To completely eliminate fraudulent claims of missing, damaged, or leaked items, Elixir Cipher Perfumes enforces a strict verification protocol. No claims for transit damage, incorrect variants, or empty vials will be entertained without a valid unboxing video.

• Continuous & Untampered: The video must be a single, continuous shot with zero edits, zero cuts, and no pauses.
• Clear Labelling: The video must begin by showing the shipping label clearly on camera, proving the tracking number, name, and seals are fully intact before opening.
• 360-Degree View: You must show a full 360-degree view of the outer box/flyer to prove it has not been opened, sliced, or resealed from the bottom or sides.
• Real-time Inspection: The video must clearly capture the exact moment the box is sliced open and show the individual decant vials being pulled out and inspected on camera.
• Rejection Criteria: Videos that are blurry, edited, start after the outer package has already been partially opened, or fail to show the shipping label will be automatically rejected. You must report any transit discrepancies within 24 hours of delivery along with this video evidence.

Absolute No-Refund & No-Return Policy (Hygiene Safe Harbor)

• Hygiene Regulations: Because perfumes are cosmetic items and our decants are custom-poured into sterile vials, all sales are final.
• No Returns/Exchanges: For strict health, hygiene, and anti-contamination purposes, we cannot accept returns, modifications, or exchanges on any opened, tested, or untestered fragrances under any circumstances once the shipment has departed our Pune facility.

Billing, Anti-Fraud, & Order Rejection

• Right to Refuse Service: We reserve the right to cancel or reject any order at our sole discretion. This includes orders flagrantly flagged by our payment gateways for suspected fraud, or orders placed by competing commercial entities, distributors, or unauthorized resellers.
• Pricing Discrepancies: If a human error or technical glitch causes a fragrance to be listed at an incorrect price, we reserve the right to cancel any orders placed under that error, issue a full refund, and update our pricing catalog immediately.

Absolute Limitation of Liability

To the maximum extent permitted under the Consumer Protection Act, 2019, and other applicable Indian statutes, Elixir Cipher Perfumes, its sole proprietor, directors, and employees shall not be liable for any indirect, incidental, special, or consequential financial losses, physical injuries, or reputational damages arising out of the use of our website or products. Our maximum aggregate liability for any legal claim shall never exceed the exact retail amount paid by you for the specific disputed item.

Legal Indemnification

You agree to indemnify, defend, and hold harmless Elixir Cipher Perfumes and its owner against any legal actions, claims, financial demands, penalties, or litigations (including lawyer fees) arising out of your breach of these Terms, your misuse of the fragrances, or your violation of any third-party intellectual property rights.

Governing Law & Local Jurisdiction

• Governing Law: These Terms and all commercial transactions shall be governed by and interpreted strictly in accordance with the federal laws of the Republic of India and the state laws of Maharashtra.
• Exclusive Jurisdiction: Any legal disputes, court filings, consumer forum complaints, or arbitrations arising from your engagement with Elixir Cipher Perfumes shall be subject exclusively to the courts located in Pune, Maharashtra, India, to the exclusion of all other geographical jurisdictions.
